Is your surrogate not in California?

SURROGACY

EGG DONATION

A critical item that you need in the egg donor contract should make it crystal clear that the donor is knowingly, and voluntarily, terminating any potential parental rights, so that any child born as a result of the donation is legally your child. Other legal issues include whether you want genetic testing beyond those commonly performed to screen out particular genetic issues and what information will be requested from the Donor for future medical use of your child. Additionally, the decision of whether and under what circumstances there will be future contact with the Donor needs to be in the contract.

EMBRYO DONATION

Embryo donations fall into two categories:
Known and anonymous. In anonymous donations, the donors and recipients choose to have no present or future contact with each other. In a known donation, the donor couple takes part in the selection of who will receive their embryos. Some unique legal issues in known embryo donations include whether any children of the donors and the resulting children of the Intended Parents will be told about the doner
